In South Africa, “we consulted” is not a defence
South African law does not ask whether you engaged. It asks you to produce the record.
The register of interested and affected parties, the comments and responses report, the proof of notice and service, the attendance registers and the minutes are statutory artefacts, not project admin. And when a process is challenged, it is challenged under the Promotion of Administrative Justice Act, where the defence is entirely documentary.
Most of it still sits in spreadsheets, shared drives and Outlook folders. That works until the volume grows, the practitioner who built the workbook leaves, or somebody asks for the register.
The obligations are below. Everything else on this page is about meeting them without a fortnight of collating.
30 days minimum comment period for all potential and registered I&APs on every submitted report, under EIA Regulation 40
3 meetings a year minimum with mine communities to report on SLP implementation, under the MPRDA Regulations
257 municipalities with statutory community participation duties under Chapter 4 of the Municipal Systems Act
R10 million maximum administrative fine under POPIA, with offences carrying up to 10 years’ imprisonment

Built around the artefacts South African law asks for
Not a contact database with a South African flag on it. Three things, done properly.
- Register and Map
- Engage and Record
- Report and Evidence
Hold every interested and affected party against the project and the activity they relate to, with the fields Regulation 42 requires and the ones your practitioners actually need: how they registered, which notice they received, which language they asked for, whether they are an organ of state, an adjacent landowner, a ratepayers’ association, a traditional council or a holder of informal rights. Map them by location, influence and interest.
No caps on how many records you hold.

Meetings, site notices served, calls, emails, focus group sessions, imbizo attendance, written submissions and comment forms, all attached to the party they came from. Email sent through the platform is saved automatically against the record, so the trail exists without anyone remembering to file it.
A shared project mailbox can be connected so inbound correspondence lands in the same place.

Comments and responses as an export rather than a fortnight of collating. Commitments tracked from a public meeting to closure. Grievances logged, categorised and closed.
More than 150 pre-built reports, a full date-stamped audit trail, and output in the languages your community actually reads.

One system for your whole engagement record
Manage every project, party and process in one place. Tractivity combines stakeholder engagement tools with AI-assisted analysis, so you spend less time collating and more time engaging.
Register of interested and affected parties
Names, contact details and addresses, how each party registered, and every organ of state with jurisdiction. Open for inspection and exportable on demand.
Public participation management
Notice programmes, comment periods, attendance registers and minutes, with proof of service held against each recipient rather than in aggregate.
Comments and responses reporting
Every comment, its author, the response and who gave it. Exported as the appendix your Basic Assessment Report, Scoping Report or EIA Report needs.
Commitment tracking
Owner, value, due date and reporting cycle on every commitment made in a public meeting, an SLP, a REIPPPP economic development obligation or a licence condition.
Grievances and enquiries
Complaints, grievances, project feedback and requests for information, date-stamped and categorised by project phase, issue, source, sentiment and handler.
Multilingual document output
One notice, Background Information Document or executive summary held in as many language versions as the project needs, with the version each party received tracked.
POPIA and GDPR controls
Role-based permissions at project, module and record level, configurable collection notices, opt-in and objection state held per recipient, and a full audit trail.
AI-assisted analysis
Sentiment analysis across issues and AI summarising of engagement records, switched off by default, run inside our Microsoft Azure environment, and never used to train a model on your data.
Spreadsheets do not survive a PAJA review
A spreadsheet is uncontrolled by default, which means a stakeholder comment can be altered or deleted with no record that it existed. A University of Hawaii study found 94% of spreadsheets contain errors, with an error in roughly one in every 20 cells. On a register you have to hand to a competent authority, that is not a productivity problem.Your stakeholder database is a POPIA question before it is anything else
An I&AP register is a database of named people you are required by law to hold, populated by people who did not ask to be on it. POPIA extends to juristic persons, so a ratepayers’ association, a community trust or a traditional council is itself a data subject. Race, political persuasion and trade union membership are prohibited by default under sections 26 to 33, and South African public participation records all three as a matter of routine.
We have written the full analysis, because nobody else in this market has.
Mining and resources
Meaningful consultation under MPRDA Regulation 3, SLP consultation and annual reporting to the DMPR, mine community and labour-sending area engagement, grievance mechanisms.
Energy, transmission and renewables
Servitude and landowner engagement for the Independent Transmission Programme, REIPPPP community trust and socio-economic development obligations, NERSA public hearings, National Nuclear Regulator engagement.
Municipalities and metros
IDP and budget public participation, ward committee coordination, petitions and complaints under section 17, SPLUMA land development applications, atmospheric emission licensing.
Water boards and catchment management
Water use licence public participation under Regulations 17 to 19, bulk infrastructure engagement, catchment forum coordination.

Tractivity has been revolutionary in terms of how we manage our stakeholders and the relationships with them. It’s very user-friendly and very intuitive. It absolutely has added value to the organisation, speeding up our processes and holding all data centrally.

Yes. Tractivity is a stakeholder relationship management platform used by organisations in South Africa, including Transnet and Lesedi Nuclear Services. It holds a register of interested and affected parties, records every engagement against the party it relates to, produces comments and responses reporting, tracks commitments and manages grievances, which are the artefacts required by the EIA Regulations 2014, the MPRDA Regulations and the Municipal Systems Act.
Tractivity’s controls map to the eight conditions for lawful processing in Chapter 3 of the Protection of Personal Information Act 4 of 2013: role-based permissions at project, module and record level, a full audit trail, configurable collection notices for section 18, opt-in and objection state held per recipient for section 69 direct marketing, and encryption at rest and in transit. Tractivity acts as the operator and the client as the responsible party.
Mining and resources, energy and transmission, rail and ports, municipalities, water boards, and the environmental and social consultancies that run public participation on their behalf. The obligations differ by sector: Social and Labour Plan consultation under the MPRDA, water use licence public participation under the National Water Act, and IDP and budget public participation under Chapter 4 of the Municipal Systems Act.
Regulation 42 of the EIA Regulations 2014 requires the applicant to open and maintain a register containing the names, contact details and addresses of everyone who submitted written comments or attended meetings during public participation, everyone who asked in writing to be added, and all organs of state with jurisdiction over the activity. The register must be open for inspection on request and supplied to the competent authority on request.
Four to six weeks on average, from contract signed to launch, covering planning calls, system set-up, configuration, data import, checks and end-user training. How long it actually takes depends as much on how quickly your data is supplied as on us.
Tractivity runs on Microsoft Azure, with UK data residency by default and European, United States and other regions available. If in-country hosting is a requirement of your tender, raise it with us at the outset so we can confirm what is available for your deployment.
Ready to evidence your engagement?
Organisations in South Africa, the UK and Europe use Tractivity to hold the register of interested and affected parties, record every engagement against the party it relates to, and produce the reporting a competent authority asks for.
