Would your consultation survive a legal challenge?
A plain-English guide to the four Gunning Principles, the legal test for a fair consultation, plus a scored self-audit that shows you exactly where your consultation is defensible and where it’s vulnerable. Free to download and yours to keep.
What's inside
Two tools that work together: a guide to understand the Gunnings principles, and a self-audit to score your consultation. Built for stakeholder engagement, communications and programme teams in local government, infrastructure, health and regulated sectors.
The Gunning Principles, explained
What the four principles are, why public consultations get challenged, a worked example of a defensible versus a vulnerable consultation, and the red flags to catch early.
Score your consultation
Answer 'Yes', 'Partly' or 'No' across the four principles. The tool rates each one and gives an overall readiness result: 'Defensible', 'At risk' or 'Vulnerable'.
The four principles, in brief
A fair consultation has to satisfy all four principles to be meaningful and legally robust. Together, they ensure consultation is not just a formality, but a transparent and credible process that builds trust, improves decisions, and reduces the risk of legal challenge.
1.
Consult while the proposal is still at a formative stage.
2.
Present clear reasons and alternatives for an informed response
3.
Allow adequate time to consider and respond.
4.
Conscientiously take the responses into account.
Our Consultation Compliance Kit helps you design fair, lawful, and effective consultations that truly engage stakeholders.
The principle most likely to land you in court
In practice, the fourth principle, taking responses into account, can put you at risk, and it comes down to evidence. You can run a textbook consultation and still struggle if, months later, you can’t produce a complete, auditable record of who responded, what they said, and how it shaped the decision.
That’s an evidence problem before it’s a legal one, and it’s where spreadsheets break down. It’s exactly the record Tractivity is built to keep: every response logged against the stakeholder it came from, themed and analysed, and exportable when scrutiny arrives.
